From the approval ...
With the approval come some 30 conditions the developer must adhere to in order to move forward with the project, including preserving the historic Life Saving buildings.

Plans call for Chera to preserve one of the buildings on the original site and to relocate the other two stations to off-site locations where they also will be restored.

From the developer ...
Zaro also explained that Chera is not required to save the historic structures.

"These buildings are unquestionably old and have an interesting history to them," Zaro said. "But they are not protected structures.As such, my client could have knocked them down.

"In recognition of the sentiments of so many people, my client said that he will do what he can to accommodate the one building and do what he can to preserve the other two buildings.

"This is something he agreed voluntarily to do.

"Mr. Chera hasn't gotten the credit he deserves for voluntarily agreeing to preserve the one building on the site and the two other buildings off-site.

"He could have demolished them," Zaro said, adding, "He is a good person who is doing what he can to do the best that he can."

In the days after local anglers drew attention to the fence, a large gate has remained open for access to the beach and water.

However, city officials said, there is nothing they can do officially to force the gate to remain open.

Mayor Adam Schneider, who has been negotiating with Chera over this issue, said the developer is inclined to keep the gate open, provided he can somehow ensure the safety of the historic buildings on site.

"We can't put a cop on his property to protect those buildings, and he is very concerned about those buildings," Schneider said.

The former beach club is the site of three buildings that date to various eras of the U.S. Lifesaving Service, a precursor to the modern-day Coast Guard. Under the CAFRA Permit, Chera must preserve one of the buildings there and relocate the others.

But Schneider said his office and Chera's have received numerous complaints from residents of the Imperial House, which abuts the property, who say people are using the buildings and cabanas on site at all hours. The mayor added that Chera
told him his insurance company has raised concerns about how to safeguard the buildings.

Lawrence F. Jacobs, who is Chera's environmental attorney, confirmed that the contract-purchaser wants to find a way to protect the site, along with those anglers and surfers who use it to access the water.

"The mayor has contacted our client and asked we consider providing access," said Jacobs. "Our client is willing to do so voluntarily, but to provide the access in a way that will protect the buildings, protect the people who will be walking through the site and to coordinate whatever we work out with the city on a voluntary basis."

Future Prevention? From The Asbury Park Press

A portion ..

LONG BRANCH — Those living in historic city homes would be asked to voluntarily designate their properties for preservation, while institutions also could go on such a list, under the terms of an ordinance being revised by City Attorney Mark R. Aikins.

The proposal would create a historical commission, which would review historically significant applications slated to go before the Planning Board or Zoning Board of Adjustment, and would offer advice for how to proceed with alterations to existing sites or plans for compatible sites.
